1. Introduction

Welcome to Algomaxx ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Algomaxx Smart Pro trading indicator and related services, including our website, indicators, and support services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you do not have permission to access the Service.

2. Definitions

  • "Service" refers to the Algomaxx Smart Pro trading indicator and all related services, content, and functionality.
  • "User," "You," and "Your" refer to the individual, entity, or organization that has visited or is using the Service.
  • "Content" refers to any data, information, material, or content available through the Service.
  • "Subscription" refers to the purchased access to the Service for a specified period of time or indefinitely (lifetime access).

3. Account Registration and Payment

To access our Service, you must provide your TradingView ID and complete the payment process. You are responsible for maintaining the confidentiality of your login information for any third-party platforms used with our Service.

By purchasing a Subscription, you agree to provide accurate and complete payment information. All payments are processed through secure third-party payment processors. Prices are subject to change, but changes will not affect existing paid Subscriptions.

You acknowledge that all sales are final and that no refunds will be issued, as detailed in our Refund Policy.

4. Service Access and License

Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal or internal business trading activities.

You may not:

  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or content obtained from the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Remove any copyright, trademark, or other proprietary notices
  • Transfer your license or access to another individual or entity
  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law

5. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Algomaxx and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks, trade names, and logos may not be used in connection with any product or service without the prior written consent of Algomaxx.

6. User Responsibilities

By using our Service, you agree to:

  • Use the Service only for lawful purposes and in accordance with these Terms
  • Not use the Service in any way that could damage, disable, overburden, or impair the Service
  • Not attempt to gain unauthorized access to any portions of the Service
  • Not copy, distribute, modify, or create derivative works of the Service
  • Assume full responsibility for your trading decisions and any resulting consequences

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. ALGOMAXX EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results that may be obtained from the use of the Service will be accurate or reliable
  • The quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations

8. Limitation of Liability

IN NO EVENT SHALL ALGOMAXX, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Trading losses incurred as a result of using the Service
  • Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount you paid for the Service.

9. Risk Disclosure

Trading financial instruments, including forex, cryptocurrencies, stocks, futures, and options, involves substantial risk of loss and is not suitable for all investors. The high degree of leverage can work against you as well as for you.

Before deciding to trade, you should carefully consider your investment objectives, level of experience, and risk appetite. The possibility exists that you could sustain a loss of some or all of your initial investment and therefore you should not invest money that you cannot afford to lose.

You should be aware of all the risks associated with trading and seek advice from an independent financial advisor if you have any doubts.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Indemnification

You agree to defend, indemnify, and hold harmless Algomaxx and its licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of [YOUR JURISDICTION], without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
